AN ACT to affirm and validate the

Universal Service Fund Rules, 2006 and the Research and Development Fund Rules, 2006.

No. C-3/1/2009-AJKC.—The following Act passed by the Azad Jammu and Kashmir Council on 2nd day of June, 2009 and authenticated by the Chairman, Azad Jammu and Kashmir Council is hereby published for general information.

            WHEREAS it is expedient to affirm and validate the Universal Service Fund Rules, 2006 and the Research and Development Fund Rules, 2006, for the purposes hereinafter appearing;

            It is hereby enacted as follows:—

1.         Short title and commencement.—(1) This Act may be called the Azad Jammu and Kashmir Council Universal Service Fund and the Research and Development Fund (Validation of Rules) Act, 2009.

            (2)    It shall come into force at once.

2.         Validation of certain rules.—(1) The Universal Service Fund Rules, 2006 and the Research and Development Fund Rules, 2006 made under the Pakistan Telecommunication (Re-organization) Act, 1996 (XVII of 1996) as in force in Azad Jammu and Kashmir under the Azad Jammu and Kashmir Council Adaptation of Pakistan Telecommunication (Re-organization) Act, 2005 (I of 2005), and all notifications amending the aforesaid Rules immediately before the commencement of this Act are hereby affirmed and shall be deemed always to have been validly made subject to the modifications that the expression “Controller General of Accounts” shall be construed to refer to the “Controller General of Accounts of Azad Jammu and Kashmir” and shall be deemed always to have had effect accordingly.

            (2)    Anything done, fee levied, charged or collected, proceedings initiated, notices issued, actions taken, orders passed or made, penalty imposed, power exercised or conferred on any authority immediately before the commencement of this Act shall be deemed always to have been validly done, levied, charged or collected, initiated, issued, taken, passed or made, imposed, exercised or conferred and so much of such fee as has not been levied, charged, paid or collected before the commencement of this Act shall be leviable, chargeable and recoverable in accordance with the this Act and deemed always to have had effect accordingly.
